This Privacy Policy (hereinafter referred to as the “Privacy Policy”) applies to all information that the online store “krivoikoso.com / krivoikoso.ru,” located at the domain name krivoikoso.com / krivoikoso.ru, may obtain about the User while the User is using the online store’s website, programs, and products.
DEFINITION OF TERMS
The following terms are used in this Privacy Policy:
- “The website administration of the online store krivoikoso.com, krivoikoso.ru (hereinafter referred to as the ‘Website Administration’)” — authorized employees responsible for managing the website, acting on behalf of Individual Entrepreneur A.Y. Kosova (TIN: 502498996450), which organizes and carries out the processing of personal data, as well as determines the purposes of personal data processing and the scope of personal data.
- “Personal data” means any information relating directly or indirectly to an identified or identifiable natural person (data subject).
- “Processing of personal data” means any action (operation) or set of actions (operations) performed with or without the use of automated means on personal data, including the collection, recording, organization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, disclosure, access), anonymization, blocking, deletion, and destruction of personal data.
- “Confidentiality of personal data”—a requirement that the Operator or any other person who has gained access to personal data must comply with, prohibiting the dissemination of such data without the consent of the data subject or the existence of another legal basis.
- “User of the Online Store Website (hereinafter referred to as the ‘User’)” – a person who has access to the Website via the Internet and uses the Online Store Website.
- “Cookies” — a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time the user attempts to open a page on the corresponding website.
- “IP Address”—a unique network address of a node in a computer network built using the IP protocol.
SCOPE OF THE PRIVACY POLICY
This Privacy Policy sets forth the obligations of the online store’s website administration regarding the non-disclosure and protection of the confidentiality of personal data that the User provides at the request of the website administration when registering on the online store’s website or when placing an order to purchase Goods. The personal data authorized for processing under this Privacy Policy is provided by the User by filling out registration forms on the krivoikoso.com online store website and includes the following information:
- the User’s last name, first name, and patronymic;
- the User’s contact phone number;
- email address;
- the delivery address for the Product;
- the User’s place of residence.
The online store protects Data that is automatically transmitted while viewing ad units and when visiting pages on which the system’s statistical script (“pixel”) is installed: Disabling cookies may result in the inability to access parts of the online store’s website that require authorization. PURPOSES OF COLLECTING USERS' PERSONAL INFORMATION
The online store’s website administration may use the User’s personal data for the following purposes: Identifying Users registered on the online store’s website to place orders and/or enter into a remote sales contract with krivoikoso.com or krivoikoso.ru; providing Users with access to personalized resources on the online store’s website; Establishing communication with the User, including sending notifications and requests regarding the use of the online store’s website, the provision of services, and the processing of requests and inquiries from the User. Determining the User’s location to ensure security and prevent fraud. Verifying the accuracy and completeness of the personal data provided by the User. Creating an account for making purchases, if the User has consented to creating an account. Notifying the User of the Online Store Website about the status of the Order. Processing and receiving payments, verifying tax liability or tax exemptions, resolving payment disputes, and determining the User’s eligibility for a credit line. To provide the User with effective customer and technical support in the event of issues related to the use of the online store’s website. To provide the User, with their consent, with product updates, special offers, pricing information, newsletters, and other information on behalf of the online store or its partners. To conduct advertising activities with the User’s consent. To provide the User with access to the websites or services of the Online Store’s partners for the purpose of obtaining products, updates, and services.
METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING
The User’s personal data is processed without any time limit, by any lawful means, including in personal data information systems, with or without the use of automated tools. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular, courier services, postal service providers, and telecommunications operators, solely for the purpose of fulfilling the User’s order placed on the “krivoikoso.com” online store website, including the delivery of the Goods. The User’s personal data may be transferred to authorized government agencies of the Russian Federation only on the grounds and in accordance with the procedures established by the legislation of the Russian Federation. In the event of loss or disclosure of personal data, the Website Administration shall inform the User of such loss or disclosure. The Website Administration takes the necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions by third parties. The Site Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
OBLIGATIONS OF THE PARTIES
THE USER IS REQUIRED TO:
Provide the personal data necessary to use the online store’s website. Update and supplement the personal data provided in the event of any changes to such information.
THE SITE ADMINISTRATION IS OBLIGATED TO:
Use the information received exclusively for the purposes specified in Section 4 of this Privacy Policy. To ensure that confidential information is kept confidential, not to disclose it without the User’s prior written consent, and not to sell, exchange, publish, or otherwise disclose the User’s personal data in any other manner, except as provided in subsections 5.2 and 5.3 of this Privacy Policy. Take precautions to protect the confidentiality of the User’s personal data in accordance with the procedures commonly used to protect such information in current business practice. To block the personal data pertaining to the relevant User upon receipt of a request from the User, the User’s legal representative, or an authorized body responsible for protecting the rights of data subjects, for the duration of the verification period, in the event that inaccurate personal data or unlawful actions are identified.
LIABILITY OF THE PARTIES
The Site Administration, having failed to fulfill its obligations, shall be liable for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Russian Federation, except as provided for in subparagraphs 5.2, 5.3, and 7.2 of this Privacy Policy. In the event of the loss or disclosure of Confidential Information, the Website Administration shall not be liable if such confidential information: had become public knowledge prior to its loss or disclosure; was obtained from a third party prior to its receipt by the Website Administration; or was disclosed with the User’s consent.
DISPUTE RESOLUTION
Before filing a lawsuit regarding disputes arising from the relationship between the User of the Online Store website and the Site Administration, it is mandatory to submit a claim (a written proposal for voluntary dispute resolution). The recipient of the claim shall, within 30 calendar days of receiving the claim, notify the claimant in writing of the results of the claim’s review. If no agreement is reached, the dispute will be referred to a court in accordance with the current legislation of the Russian Federation. This Privacy Policy and the relationship between the User and the Site Administration are governed by the applicable laws of the Russian Federation.
ADDITIONAL TERMS
The Site Administration reserves the right to amend this Privacy Policy without the User’s consent. The new Privacy Policy takes effect upon its publication on the online store’s website, unless otherwise specified in the revised version of the Privacy Policy.
